Acceptance of Terms
By downloading, installing, accessing, or using EdgeVara (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to any part of these Terms, you may not use the Service. Your use of EdgeVara constitutes acceptance of these Terms.
Description of Service
EdgeVara is a trading psychology, journaling, and habit tracking platform available on Windows. Features include: trade journal, sleep tracking, habit tracking, and cross-device cloud synchronization. EdgeVara is a tool for self-improvement and trading psychology — not a trading platform, broker, or investment advisor.
User Accounts & Responsibility
You must create an account with accurate, current information to use EdgeVara. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You should report unauthorized access or use, but EdgeVara and its founder are not liable for any losses resulting from unauthorized account access, regardless of notification.
Financial Disclaimer & No Investment Advice
EdgeVara is a journaling and psychology tool. It does NOT provide financial advice, investment recommendations, trading signals, or specific market guidance. The platform provides observations and feedback based solely on your own journal entries and personal trading data. Past trading performance does not guarantee future results. Trading and investing involve substantial risk of loss. You are solely responsible for all trading decisions.
Subscriptions, Billing & Auto-Renewal
EdgeVara subscriptions are billed in advance on a monthly or annual basis. By providing payment information, you authorize EdgeVara to charge your payment method for recurring subscription fees. Subscriptions automatically renew unless canceled before the renewal date. You may cancel anytime through your account settings; cancellation takes effect at the end of your current billing period. ALL SUBSCRIPTIONS ARE NON-REFUNDABLE. We do not issue refunds, credits, or prorated refunds for partial periods, unused time, or canceled subscriptions, except where required by applicable law. Payment processing is handled by third-party payment processors.
Payment Methods & Authorization
You authorize EdgeVara and our payment processors to charge your provided payment method (credit card, debit card, or other payment instruments) for all subscription fees, applicable taxes, and other charges due under these Terms. You represent that you are authorized to use the payment method you provide. You agree to keep your payment information accurate and current. You are responsible for all charges incurred under your account.
Acceptable Use Policy
You agree not to use the Service for: (a) any unlawful, fraudulent, or deceptive purpose; (b) attempting to reverse engineer, decompile, or access the source code; (c) sharing login credentials or reselling access; (d) using automated scrapers, bots, or data collection tools; (e) transmitting malware, viruses, or malicious code; (f) harassing, threatening, or abusing other users; (g) any activity that violates applicable laws or regulations. Violation may result in immediate account suspension or termination.
Data Privacy & Security
Your use of the Service is governed by our Privacy Policy. We collect, store, and process personal data in accordance with applicable privacy laws. You retain full ownership of your journal entries and trading data. You grant EdgeVara a limited, non-exclusive license to access and process your data solely to operate and deliver the Service to you. The Service is provided without any guarantee of data security or breach prevention. To the maximum extent permitted by law, neither EdgeVara nor its founder shall be liable for any data loss, breach, unauthorized access, or data-related damages. You acknowledge that data transmission and storage carry inherent risks.
Intellectual Property Rights
EdgeVara, including all software, designs, content, and features, is owned by the founder and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without express written permission. You retain full ownership of your journal entries, trading data, and personal content. By using EdgeVara, you grant us a worldwide, royalty-free license to use, display, and analyze your data to improve the Service.
Third-Party Services & Links
EdgeVara may integrate with or provide links to third-party services and payment processors. We are not responsible for third-party content, services, or their privacy practices. Your use of third-party services is subject to their terms. We do not endorse or assume liability for third-party services or their conduct.
Limitation of Liability & Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER EDGEVARA NOR ITS FOUNDER SHALL BE LIABLE FOR: (a) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; (b) LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY; (c) TRADING LOSSES OR POOR TRADING OUTCOMES OF ANY KIND; (d) SERVICE INTERRUPTIONS, DELAYS, OR ERRORS. YOU ACKNOWLEDGE THAT TRADING INVOLVES SUBSTANTIAL FINANCIAL RISK AND THAT YOU USE EDGEVARA SOLELY AS A JOURNALING AND PSYCHOLOGY TOOL. EDGEVARA AND ITS FOUNDER ACCEPT NO RESPONSIBILITY OR LIABILITY FOR ANY TRADING DECISIONS, FINANCIAL LOSSES, OR INVESTMENT OUTCOMES. EDGEVARAS TOTAL LIABILITY FOR ANY CLAIM DOES NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
Disclaimers as to Service Availability
EdgeVara is provided "as is" without warranty of any kind. We make no warranties regarding uninterrupted service, error-free operation, or that defects will be corrected. We do not warrant that the Service will meet your requirements or that results will be accurate or complete. Trading involves risk; EdgeVara does not guarantee profitable outcomes or protection against losses. Use at your own risk.
Account Termination & Service Suspension
EdgeVara reserves the right to suspend or terminate your account and access to the Service at any time, for any reason, with or without notice. Reasons include: violation of these Terms, non-payment, fraudulent activity, or any conduct deemed harmful. Upon termination, your right to use the Service immediately ceases. You remain liable for all outstanding charges. You may request your data within 30 days of termination in accordance with applicable law.
Changes to Terms & Service
EdgeVara may modify these Terms at any time. Changes take effect when posted on our website. Your continued use after changes are posted constitutes acceptance of the updated Terms. We may discontinue, suspend, or modify the Service at any time. We are not liable for any loss resulting from Service modifications or discontinuation.
Dispute Resolution
Any legal action or proceeding arising out of these Terms must be brought within one (1) year of the claim arising or be barred. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and EdgeVara regarding your use of the Service. These Terms supersede all prior agreements, whether written or oral. If any provision is found unenforceable, the remaining provisions remain in effect.
